Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your access to and use of the Atelo booking and client management platform, the website getatelo.com, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Atelo is a trading name of Kamdithecreator Ventures, a business registered in Nigeria. References to "Atelo," "we," "us," or "our" in these Terms mean Kamdithecreator Ventures, operating the Service under the Atelo brand. Customer payments processed through the Service may appear on bank statements under either trading name.
2. Who can use Atelo
You must be at least 18 years old and able to enter into a binding contract to use Atelo. If you use the Service on behalf of a business, you confirm that you have authority to bind that business to these Terms.
3. Your account
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at support@getatelo.com if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms, engage in fraud, chargeback abuse, or that we reasonably believe pose a risk to the Service or to other users.
4. Subscriptions, fees, and payments
Atelo is offered on paid subscription tiers ("Emerging" and "Atelier"). Current pricing is shown on the Atelo website and in your dashboard. By subscribing, you authorize us to charge the selected plan fee through Paystack on a recurring basis until you cancel.
Atelo also charges a per-booking platform fee on bookings processed through the Service. The platform fee percentage varies by tier and is shown to fashion houses on the booking initialization screen. Client-facing Paystack transaction fees are disclosed to clients at checkout.
Subscription fees are non-refundable except where required by applicable law or explicitly offered by us in writing. Per-booking platform fees on cancelled bookings are handled according to our cancellation and refund rules, which we may update from time to time.
5. Your content and clients' data
You retain ownership of the content you put into Atelo — including your business profile, services, availability, and the client records and booking data you create. You grant us a non-exclusive license to host, process, and display this content solely to provide the Service.
You are the data controller for your clients' personal data. You must have a lawful basis to collect and store the client information you add to Atelo (names, phone numbers, email addresses, measurements, notes). You are responsible for informing your clients about how you use their data and, where required, obtaining their consent.
6. Acceptable use
You must not:
- Use the Service for anything illegal, fraudulent, or harmful.
- Attempt to access another fashion house's data or clients.
- Send spam, unsolicited marketing, or content that violates WhatsApp or Twilio policies through the Service.
- Reverse-engineer, probe, or attempt to circumvent security controls.
- Resell, sublicense, or white-label the Service without our written permission.
7. Third-party services
Atelo relies on third-party services — Google Firebase for auth and data, Paystack for payments, Twilio for WhatsApp, Brevo for email, Google Calendar (optional, only if you connect it), and Cloudflare Turnstile for bot protection. Your use of Atelo is also subject to those providers' terms. We are not responsible for outages or changes in those services, but we will make reasonable efforts to restore functionality or provide workarounds.
8. Notifications
Booking confirmations, reminders, and status updates are sent to both fashion houses and clients primarily via WhatsApp, with email as a backup. Delivery depends on the recipient's device, network, and WhatsApp / email provider and cannot be guaranteed. If a notification is critical, verify it in the dashboard.
9. Availability and changes
We aim for high availability but do not guarantee the Service will be uninterrupted, timely, secure, or error-free. We may add, remove, or change features; we will give reasonable notice of material changes that negatively affect paying customers.
10. Intellectual property
The Atelo name, logo, visual design, code, and documentation are owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding beyond using the Service as intended.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will meet your requirements or operate without interruption.
12. Limitation of liability
To the maximum extent permitted by law, Atelo will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost bookings, lost data, or goodwill, arising out of your use of the Service. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the three months preceding the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnity
You agree to indemnify and hold Atelo harmless from any claim arising out of your content, your use of the Service, your violation of these Terms, or your violation of any third party's rights — including data-protection and privacy obligations to your clients.
14. Termination
You may cancel your subscription at any time from your dashboard. Cancelling stops future recurring charges; you will retain access until the end of the current billing period. We may suspend or terminate your access for breach of these Terms. Upon termination, you may export your data for 30 days before we delete or anonymize it in accordance with our Privacy Policy.
15. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved in the courts of Lagos, Nigeria, unless applicable consumer law gives you a right to bring proceedings elsewhere.
16. Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date at the top of the page and, if the changes are material, notify account holders via email or in-app notice at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance.
